**The Cycle Pit - Terms and Conditions**
These Terms and Conditions ("Terms") govern your use of The Cycle Pit's indoor cycling studio ("Studio"). By participating in any activities, classes, or services offered by The Cycle Pit, you agree to be bound by these Terms. Please read them carefully.
1. **Participation:**
1.1. You must be at least 18 years old to participate in any activities at The Cycle Pit.
1.2. Participation in classes may be subject to completion of necessary paperwork and health assessments.
1.3. The Cycle Pit reserves the right to refuse participation to anyone deemed unfit for activities.
2. **Health and Safety:**
2.1. You acknowledge and agree that participation in cycling activities involves certain risks, including but not limited to, physical injury.
2.2. You are responsible for assessing your own health and fitness level and determining whether you are capable of participating in cycling activities.
2.3. Please inform The Cycle Pit staff of any pre-existing medical conditions, injuries, or concerns before participating in any activities.
3. **Studio Rules and Conduct:**
3.1. Follow all instructions given by The Cycle Pit instructors and staff.
3.2. Respect other participants and staff members.
3.3. No disruptive or disrespectful behavior will be tolerated.
3.4. The use of mobile phones or other electronic devices during classes is prohibited, unless for emergencies.
4. **Filming and Media Content:**
4.1. By participating in classes at The Cycle Pit, you consent to the possibility of being filmed or photographed for media content purposes, including but not limited to promotional materials, social media, and website content.
4.2. If you do not wish to be filmed or photographed, please inform The Cycle Pit staff before the class begins.
4.3. The Cycle Pit will make reasonable efforts to ensure that any filming or photography respects the privacy and comfort of participants.
5. **Booking and Cancellations:**
5.1. Class bookings are subject to availability and must be made in advance.
5.2. Cancellations must be made at least 12 hours before the scheduled class time to avoid penalty.
5.3. Late cancellations or no-shows will not be subject to a refund.
6. **Fees and Payments:**
6.1. Single class fees and class packages are subject to change at the discretion of The Cycle Pit.
6.2. All fees must be paid in full before participating in any activities or services.
7. **Intellectual Property:**
7.1. All intellectual property rights associated with The Cycle Pit, including but not limited to logos, branding, and content, are owned by The Cycle Pit.
7.2. You may not use The Cycle Pit's intellectual property without prior written consent.
8. **Liability Waiver:**
8.1. By participating in any activities or services provided by The Cycle Pit, you agree to release The Cycle Pit, its instructors, staff, and affiliates from any liability for injury, loss, or damage sustained during or as a result of participation.
8.2. You understand and accept all risks associated with cycling activities.
8.3. The Cycle Pit is not responsible for any personal losses, including but not limited to theft, damage to personal property, or financial losses incurred while on The Cycle Pit premises.
9. **Changes to Terms:**
9.1. The Cycle Pit reserves the right to modify or update these Terms at any time. Notice of changes will be provided to members via email or posted in the Studio.
9.2. Continued use of The Cycle Pit's services after the effective date of any changes constitutes acceptance of the modified Terms.
10. **Governing Law:**
10.1. These Terms shall be governed by and construed in accordance with the laws of Scotland.
10.2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Scotland.
By using The Cycle Pit's services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree to these Terms, please refrain from using The Cycle Pit's services.
